Terms of Service
These Terms govern your use of Kivo Messenger and its related services. By creating or using a Kivo account, you agree to them.
1. Eligibility and authority
You must be legally able to agree to these Terms in your location. If local law requires consent from a parent or guardian, you may use Kivo only with that consent. You may not use Kivo where doing so is prohibited by applicable law.
2. Kivo account and wallet identity
Kivo uses a non-custodial EVM-compatible wallet to create or authenticate a messaging identity. You are responsible for protecting your device, local wallet password, recovery phrase, and private key. ZhiEra does not receive or hold the wallet password, private key, or recovery phrase through the intended Kivo flow and cannot recover them for you.
Your public wallet address is not secret. It may be visible through Kivo discovery and on public blockchains. Public blockchain activity may be permanent and outside ZhiEra's control.
3. Communication service
Kivo provides private messaging, groups, media sharing, and audio/video calling features supported by the current release. Availability can depend on devices, permissions, connectivity, service capacity, and the other participant. Kivo is not an emergency communications service and must not be used to contact police, fire, medical, or other emergency services.
4. Acceptable use
You must not use Kivo to:
- violate law or another person's rights, privacy, intellectual property, or safety;
- threaten, exploit, harass, impersonate, defraud, or distribute unlawful content;
- send spam, malware, phishing, abusive automated traffic, or unauthorized commercial messages;
- probe, attack, disrupt, reverse engineer service credentials, evade rate limits, or interfere with Kivo infrastructure, except for lawful security research on open-source code;
- use another person's wallet, account, device, or identity without authorization;
- facilitate money laundering, sanctions evasion, market manipulation, or other prohibited financial activity.
You control the content you send and are responsible for it. Recipients can capture, retain, or redistribute content after receiving it, even when Kivo offers disappearing messages.
5. Blocking, reports, and enforcement
Kivo may provide tools to block users and report abuse. We may investigate abuse, rate-limit activity, remove access to services, preserve limited evidence, or take other proportionate action when reasonably necessary to protect users, comply with law, or enforce these Terms. End-to-end encryption may limit the content available to us; include only the information needed for a report and never include wallet secrets.
6. Financial and third-party services
The wallet identity in the current Kivo messaging release does not make ZhiEra a custodian of your assets. Kivo does not promise that any token, transaction, blockchain, RPC provider, or third-party service is available, accurate, lawful, or suitable for you.
Unless a future release clearly says otherwise and provides separate disclosures, Kivo does not execute token swaps, operate an exchange, offer brokerage, provide investment advice, guarantee returns, or insure digital assets. Third-party links and services have their own terms, fees, regions, risks, and privacy practices.
7. Privacy
Our Privacy Policy explains how Kivo handles information. You agree to use Kivo only in a way that respects the privacy and legal rights of other people.
8. Software and open-source licenses
ZhiEra grants you a limited, personal right to use the Kivo service and distributed app subject to these Terms and applicable store terms. Open-source components are licensed separately under their respective licenses. The Kivo iOS client's corresponding source and notices are described on the Source page.
Signal and related marks belong to their respective owners. Kivo is an independent project and is not affiliated with, sponsored by, or endorsed by Signal Messenger, LLC or the Signal Technology Foundation.
9. Service changes and termination
We may update, limit, suspend, or discontinue features to maintain security, comply with law, or improve the service. We will provide notice when reasonably practicable. You can stop using Kivo at any time and can request account deletion in the app.
We may suspend or terminate access for a material or repeated violation of these Terms, a security threat, legal requirement, or risk to users or infrastructure. Provisions that by their nature should survive termination—including responsibility, disclaimers, and open-source licenses—continue to apply.
10. Disclaimers
To the maximum extent permitted by applicable law, Kivo is provided “as is” and “as available.” ZhiEra does not warrant uninterrupted operation, delivery of every message or call, recovery of a lost wallet, compatibility with every device or network, or the accuracy or availability of public blockchains and third-party services. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
11. Limitation of liability
To the maximum extent permitted by applicable law, ZhiEra and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, communications, opportunity, profit, goodwill, digital assets, or wallet access arising from Kivo. Any limitation applies only to the extent lawful in your jurisdiction.
12. Changes to these Terms
We may update these Terms when Kivo, the law, or our operations change. We will post the updated date and provide additional notice when required. Continued use after an effective update means you accept the updated Terms where permitted by law.
